RESERVATION AND PAYMENT REGULATIONS

§ 1 General provisions

  1. These Regulations define the rules for making table reservations, paying reservation fees, canceling reservations and making payments for catering services provided by Viva Tango Spółka z ograniczoną odpowiedzialnością (hereinafter referred to as the “Restaurant”).
  2. The Regulations apply to reservations made directly at the Restaurant and via reservation portals, in particular the MojStolik portal.
  3. Making a reservation constitutes acceptance of these Regulations.

§ 2 Reservations via the MojStolik portal

  1. The restaurant allows customers to make table reservations via the external booking portal MojStolik.
  2. Reservations made via the MojStolik portal are subject to these Regulations, in particular the provisions regarding the reservation fee, cancellation of reservations and payments.
  3. The MojStolik portal serves as an intermediary tool for the reservation and payment process. The Restaurant remains the party to the catering services agreement.

§ 3 Reservation fee

  1. The Restaurant may make confirmation of the reservation conditional upon the payment of a reservation fee by the Customer.
  2. The reservation fee is a deposit and is credited towards the final invoice for catering services provided as part of the reservation.
  3. The amount of the reservation fee is always indicated to the Client before payment.

§ 4 Cancellation of reservation by the Customer

  1. The customer has the right to cancel the reservation free of charge no later than 48 hours before the scheduled reservation time.
  2. In case of:
    a) the Customer fails to appear in the Restaurant on the booked date (no-show),
    b) cancellation of the reservation after the deadline referred to in paragraph 1,
    the reservation fee is non-refundable.
  3. At the Customer’s request, the Restaurant may, at its sole discretion, allow a one-time change of the reservation date instead of forfeiting the reservation fee.

§ 5 Cancellation of reservation by the Restaurant

  1. If the Restaurant cancels the reservation for reasons attributable to it, the reservation fee will be refunded in full using the same payment method used.
  2. The refund will be made no later than 14 days from the date of cancellation.

§ 6 Right of withdrawal

  1. The Customer who is a consumer acknowledges that, in accordance with Article 38, point 12 of the Act of 30 May 2014 on consumer rights, he/she is not entitled to withdraw from the contract if the subject of the reservation is a catering or entertainment service provided on a specified day and at a specified time.
  2. The provision of paragraph 1 applies in particular to table reservations made for a specific date and time.

§ 7 Payments

  1. Payment of the reservation fee can be made:
  • via the Przelewy24 electronic payment system, operated by PayPro SA based in Poznań.
  • directly at the restaurant in cash or by card
  • by bank transfer to the bank account indicated to the Restaurant Customer
  1. PayPro SA is only an intermediary in the transfer of payments, and the beneficiary of the reservation fee is the Restaurant.

§ 8 Complaints

  1. Complaints regarding reservations or the provision of catering services should be submitted directly to the Restaurant:
    – by e-mail to the following address: restauracja@vivatango.pl
    – in writing to the address of the Restaurant’s registered office

no later than 24 hours after the reservation is completed; in the case of a written complaint, the date of the postmark is taken into account.

  1. Complaints regarding the technical handling of payments can also be submitted via the Przelewy24 operator.
  2. The restaurant will consider the complaint within 14 days of its receipt.

§ 9 Personal data

  1. The administrator of Customers’ personal data is Viva Tango Spółka z ograniczoną odpowiedzialnością, NIP: 5214037167.
  2. Customers’ personal data are processed in particular for the following purposes:
    a) completion of the reservation,
    b) collection and settlement of the reservation fee,
    c) fulfillment of accounting and tax obligations.
  3. The recipient of Customers’ personal data in the scope of payment processing is PayPro SA as the operator of the Przelewy24 system.
  4. Detailed information regarding the processing of personal data is included in the Restaurant’s Privacy Policy.

§ 10 Final Provisions

  1. In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
  2. The Restaurant reserves the right to change these Terms and Conditions. Any amended Terms and Conditions will take effect upon publication.
